ok so i got pulled over today for going 54 mph in a 45 mph. so 9 mph over. The cop gave me a $81.50 ticket and 2 points...I told the officer that i didn't see a speed limit sign and was unaware of the speed limit. I also got pulled over while on the job and in an unfamiliar place. Of course he didn't cut me any slack or even talk to me about it. Just handed me the ticket and left. As i was sitting there i just kept thinking to myself that there was no speed limit signs, because i always look for those. So i decided to drive back down the road from where i turned onto the road to where i was pulled over. And there was NO speed limit signs. However there was ONE sign before before i turned onto the road that i was pulled over on, so there was no way of me knowing what the speed limit was. I was also following a truck in front of me at a safe distance and the cop informed me that he was speeding too at 51 mph, but i guess i just got unlucky and picked me cause i was going faster. So what i want to know is, is this worth fighting for in court? I certainly don't want 2 points added to me and have to pay 81 dollars when i have proof that there was no speed limit sign. So im just wondering if i should just pay it and take the points, or fight it. I have pictures printed out and images printed out off google images to prove what i am saying.


-oh and the cop was a "Pine Ridge" police, and before i got pulled over i saw a "Pine Ridge City Limit" sign...could that have any affect? just wondering

any advice would be appreciated.

Very interesting. Try fighting it in court. 90% of the time the officer doesn't show and they throw the ticket out. Don't let them try to use a different officer as the prosecution, you have the right to face your accuser.


Also, don't listen to me. My legal advice comes from how I think the world should work, not necessarily how it works.
 
Well, I'd say you have a foot to stand on. Police tend to speed trap areas without signs just to rake in money, and a judge should know that. A clean record and you showing that you were driving safely to the best of your ability with the information you had should get you off the hook. Generally, 2 lane roads between towns or with few houses on it are 55mph with those closer to subdivisions being 45.
 
fight that in court. when you do go, explain to the prosecutor about where you were on the road when you turned on and where you got pulled over. as for the points on your license, that has nothing to do with the court system, getting points on your license is all the DMV. so either way, winning the fight in court or not, you will still recieve those points on your license. atleast thats how they run it here in ct. but as for paying for the fine, fight it or at least send it in not guilty. if you have a clean record theres a 75% chance they will nollie the ticket. if they do end up asking you to come to court, from past experience, they will most likely ask you to pay a charitable contribution of like 20$ and the ticket may be wiped clean.

not all 2 lane rds are 55mph unless it is a state highway. if its not a state highway and its just a main rd through a down more then likely the speed limit is goin to be 40-45mph. but then again that all depends on the state that you are residing in. here in ct thats how it is
 
For several years I have made it a practice to fight everything,period.
I have been amazed at how successful that has been.
I think from your description this is a speed trap. The cop will loudly dispute that in court. Go to your states D.O.T. web site and lookup speed traps and see what they say about that practice. Most states on their D.O.T. sites take a dim view of the practice as well as the general law abiding public.
Have your paper work ready for your appearance and stick to your guns.
Cops who write tickets in those conditions are A@@Holes and aren't about to cut anyone some slack.

They DEFINITELY sow up WAYYYYYY more than 10% of the time.
 
I'm thinkin' it's a lot more in NY too. You must have a pretty lax PD.
Nah... Look up Newburgh NY (although I went to a different school). The police are almost short handed, so they don't have time to waste in court. Newburgh has the highest crime rate in the country.
 
Worse comes to worse you can ask the cop to prove you were speeding. assuming you didn't admit it to him that you were. If the judge is cool, just go off of proponderance of evidence. Have the cop prove to you that the instrument he clocked you with was calibrated by an NIST professional at the time of the ticket. and that the tools that calibrated his instrument were also calibrated, and ask for letters of compliance on both. if he gives you a statement that the instrument was calibrated that morning or something just state that he could have dropped or bumped the instrument on something between said time and thrown the calibration off.

Note, this only works if you have a judge that is either
A. Willing to listen.
or
B. Knows the cop is pulling something shady but can't prove it, so will give you some slack based on the tactics i just mentioned.

Odds are however, If you have a clean driving record, and your paint depiction is correct, you will not have to come to this.

Oh I printed off the same pic but one from google maps. I marked on there just how I did on the pic from paint on here. And let's say I go to court and decide to fight it, bit then I lose... If i lose am I gonna still have to pay the $81 and get the 2 points and then regret just paying it and getting the points dropped
 
for a ticket like this, the cop is not going to show up. he or she has bigger better things to do then sit in court and wait for your name to be called so you can talk to the prosecutor. he probably wont even be informed that you will be going to court for this.
 
If you can get the points dropped guaranteed by paying I would just pay personally. but thats just so i wouldnt have to take time off work as time=money. and i make more then 81 a day. so I would lose money fighting. however depending your financial situation and schedule I dont think you would lose if you went to court. Then again I only have to go off of what is in this thread. and I dont know how the courts/cops are thier.
