Scars on spider gears

Just got a set of 4.10 dana30&35 axles from a 4 cylinder TJ. When I opened the diff cover, I found there were some scars on the spider gear (see pics). In total of 8 tooth were damaged like that. How bad are they, are they still drivable? Do I need to set/adjust backlash when replacing them? Can I use my old 3.07 spider gears (are spider gears the same regardless of ratio)? Thanks for any input!

The hardened surface on the outside of the gears has been compromised and they wont last much longer. I would replace them before putting the axles in your Jeep.
