Dealer damaged my Grand Cherokee and are now ignoring me

I had an oil leak in my 2007 CRD so my wife took it into South Bay Chrysler/Jeep (Torrance CA) for repair. It happened be just a leaking oil filter but they still charged me $150 to clean it. Got it home to still see oil dripping from it and then I noticed that they hit the rear bumper on something. There are a bunch of scratches on the driverís side of the rear bumper and yellow paint rubbed across it. Looking into the service bay there are yellow barriers all around as well as yellow poles between each bay so I know it was them. By this time the service center was closed so I took it back in the next day (Monday).

I showed the service manager the damage and he just said there was probably nothing that we could do for me but he would look to see if it was mentioned on my paperwork (which I did not receive a copy of). Came back out 15 minutes later only to tell me he could not find my paperwork and would give me a call on Tuesday. No call the next day so I called him only to be told her was still looking for my paperwork and would call on Thurs. No call Thursday or Fri so I went back in after work on Fri just to be told he was still looking for my paperwork and would call on Mon. No call on Mon so I call and spoke to his boss who only told me he would look for my paperwork and get back to me. Still no response.

At this point I am pissed. Does anyone have any ideas of how to light a fire under these guys ***? I would like to avoid going to court as it will cost me more than the repair will but if need be I will pursue that option just out of principal. Any suggestions would be much appreciated.

I would stop by the dealership on Monday and ask to speak to the owner. In today's market the last thing this dealer is going to want is bad press regarding maintenance and customer service.

If that does not work I would take lots of pictures and contact the better business bureau.

Small claims court (which is probably all you need unless the limits are really low in your state) is darn near free. And except for a few oddball states, no lawyers allowed.

But before that I'd try the general manager, and if that gets nowhere, some news station consumer reporter.

Use the court system

Get a quote for repairs and sue them in small claims court (small claims requires no lawyers involved).

My girlfriend had an issue with BMW and transferring her title to california from oregon when she moved (for registration after she refinanced; her car got towed for plates and we couldn't get it out of impound until BMW fixed an issue on their end). Long story short we sued them in small claims court and won. We didn't get the full asking amount but the court found BMW to at fault and we recovered some of our losses. At this point, I would take the Jeep to a body shop for an estimate. I would then present the estimate to the general manager of the dealership with a demand for resitution. They have insurance for such occurances and it really shouldn't cost them much out of pocket to make it right. They should also know what nuckleheads that were part of the valet crew that day and can question them about why they tried to cover up their accident. If they fail to comply, I would escalate up through Chrysler and tell them how POd you are and this crappy dealer is causing you to question future purchase of Chrysler products, etc. My 2 cents.

Thanks for all the help everyone. I did take pictures of the damage. Next time I go to the shop I will walk through the service bay and take pictures as well. I like the idea of getting a quote and taking it to them. I will do that for sure and speak to the owner of the dealer.

Sucks that it is probably a super cheap fix if they would just do it but will cost me $600 at a body shop. I would like to avoid small claims court as I am a contractor and get paid by the hour for only the hours I work. If I go to court that is probably a lost days wage. Can you sue for lost wages in small claims court?

I'd just start making as much noise as possible. Don't let them brush you off, they did it, they should pay for it and if they won't I'd take out an ad in the paper with a picture of your damage and how it happened. See if you can put it right in where they put their weekly ad and see how that sits with them.

take himto small claims court and say you want a days pay for missing work and for him to also pay the court cost too!

2007 JK Sahara- trying to figure this one out

Turn it into a simple math problem.

Explain to the dealership GM/Owner that the next step is to take your pix and file a claim with your insurance company. Assuming the dealership has a body shop, the insurance co is probably one of their big customers who will not be happy about paying for a supplier's damage.
