Quit putting it in 4wd on pavement. Get it off the hard top and try 4wd and you will see that the folks here are telling you the straight facts. As far as the some folks that are telling you that your "wheels should not be doing that on the road", please refer to my signature and keep it in mind when you are listening to "some people".

Keep in mind that free advice can frequently be worth less than you pay for it.

is it grinding when passing N to go back to 2H or is the linkage binding up and not wanting to go back to 2H you mentioned you had trouble getting it back to 2H earlier in the thread prior to the test in the mud

From 4lo to 4hi you have to Stop shift the transmission into Neutral. I have found on my XJ that going from 4hi to 2hi it was best to be rolling but not accelerating or hard deceleration in gear and slowly shift into 2hi.

If it grinds don't force Kill the engine see if it will shift smoothly then. You might need to adjust the linkage.

It doesn't grind when I shift the transfer case n to be honest I cannot remember if I had the tranny in neutral so I'll make sure to do that. N check the linkage. Thanks for the help

Sir, you need to jack up the jeep and count your driveshaft rotations vs. Your tire rotations. It sounds like you have a set of mismatched gears. You should be able to drive the jeep just fine (within reason) on pavement. Unless someone has welded the spider gears or installed a full spool in the front end it should drive down the road. If someone had welded the gears you would know already because you would barely be able to turn and the front end would hop and skip and chirp even in two wheel drive. If the gear ratios match... Remove the front driveshaft and try putting it in four wheel drive. If it is still acting weird you have a transfer case problem.
