TJGreg on this forum has the stock Rubicon axles pushing 36s. And I can vouch that he wheels his rig plenty hard. You'll be fine if you have two built 44s.

That is a pretty bold statement!

What kind of 44's?

Is it a Rubicon 44?

Is it a real 44?

Cromo shafts?

A friend of mine runs 38.5" Boggers on D44s.

The rear is a stock Rubi axle and the front is a narowed high pinion from a late 70s Ford.

The Rubi locker has given him some problems but nothing major (air line inside the diff). In the front he blows a hub pretty much everytime we go out but its an easy fix and its a good place to have the weak link. He usually carries 3 or 4 spares.

Oh, this is behind an I6 TJ that has a 75 horse shot of nitrous on it and he runs it pretty hard.

D44s will hold 37's just fine. Just drive smart.

04 Unlimited, lifted, locked, 37s, etc.......

I run 36x13.50 Iroks (measure 36.8") on the Rubi 44's with 5.13's and Alloy F/R axle shafts with no issues. Stock shafts won't live, I wrung a set 1/4 turn at the splines.

One thing about some Dana 44 front axles, which includes the Rubicon's front Dana 44, is that they still use the Dana 30's outer knuckles and ball joints. Those particular components are not really up to 37" tires, at least not in the long term.

Getting Savvy...

When you have a choice, buy American.
