I'd get a lawyer to draw one up, considering the fact that you don't know how to spell "contrack".

Why do you need a contract? Is the buyer going to be making payments to you?

Typically all you need is a bill of sale, which most Motor Vehicle Departments have either on their website or at their facilities. This simply states that you agree to sell a vehicle "as is" for a specified amount of money. As a private seller, that's about the only "contract" you need.

You need to sign over the pink slip, fill out a bill of sale AND a "release of liability".

If you don't do the later and he wrecks on the way home... Your Resposible...

lol...when I bought my snowmobile, the dude scribbled on a piece of scrap paper

"I, ____, agree to pay the full amount of $1150 for a '96 Polaris ultra to:

Jeff M.

______(your signature)"

...and that was that. Done deal. He was even nice enough to get it registered for me.

probably can't do that with a car, though.

Go to a Notary. Keep a copy of the Notarized Bill of Sale and Title

Living in Jersey at least the plates don't go with the car. I have heard of people "giving" their cars to charity and then getting screwed like your brother because the new owner never transferred the title. I think that the absolute way to protect yourself would be either to go to motor vehicle with the buyer to make sure the title is transferred or letting him pay you, sign over the title but don't let release the car to the buyer until he comes back with a transferred title in the buyers name. You can explain to the buyer that after your brother's experience you don't want that happening to you and if they don't like it they don't have to buy the car.
