As dumb as he may be - definitely smarter and smoother than the ave. criminal.
Plus, there is no way they will ever be able to prove what was on that piece of paper. They can try charging him with tampering or destruction of whatever they want - but no way to make it stick, unless MAYBE the paper "survives" the "exit" process and whomever wants to "dig a little further" into the case (:

All they can say for sure, is they have video of him eating a piece of paper. If they were more sure it was the note from the bank, they could get a warrant to retrieve it medically. I'm not sure a judge would sign that for a simple bank robbery charge though.

He does not have to prove why he ate it.
It is NOT EVIDENCE unless you can prove it was.

I'm at work and have no volume, so I don't fully understand what the significance of the paper was. However, the prosecution will probably be able to use the fact that he ate the paper as circumstantial evidence of the robber's own guilty state of mind. This type of evidence is perfectly legal and proper and is used quite often (e.g. DUI cases where the perp refuses breath analysis).

Anyone can CLAIM anything.
If I were on the jury and the prosecution tried it, not only would I discount the "evidence" completely - I would be inclined to discount anything else the prosecutor had to say - and I would be further inclined to vote the guy not guilty.

Refusal is in itself a crime, with punishment being the same as DUI.
