It would be like demanding to use a puerto rican credit card when you know it's not accepted. All they are doing is voiding the receipt. It's a loss prevention technique that saves them money and therefore provides a benefit to the members. If you don't like the drill stop sending them $35 checks so you can keep going. The walmart scenarios are a little more grey area. The argument could be made that since all items that go through checkout 'should' be deactivated, that any item triggering the sensors 'should' be stolen, and therefore provide reasonable suspicion that a larceny has occurred. You'll note I said reasonable suspicion and not probable cause. Since they are not fool proof, they don't meet that burden of proof. Most states allow for a citizens arrest in felonys and shoplifts. A triggered alarm would allow an employee to detain the person for a reasonable amount of time to determine whether or not a larceny has occurred. Being that this takes an average of 2 seconds (made that number up), having someone refuse to take the 2 seconds to clear things up would would elevate the level of suspicion. Take the greeter away and replace with a cop. You trip the alarm, he asks you to stop and knowing that you have done nothing wrong you refuse and continue to your car. You would be stopped and regardless of whether or not you've stolen anything, you'll be arrested. Why? Because by failing to comply with the lawful order to stop you've interfered with the officers ability to investigate a crime. Switch the greeter back, and will you go to jail, even if the incident is reported? No. But you can see the basis for the law. |

Registered User | I deal with this same issue every day. I proceed unless a store emloyee says something. Not my job to stop and seek out their security people. But I am perfectly willing to spend a reasonable amount of time to assist them if they stop me. By reasonable I mean less that 30 seconds. After that they need to pay me. PS I didn't read that article because it was a novel. |

Registered User | I think he's a jerk, but I do see some of his valid concerns. Wal-Mart cashiers here are the worst about actually deactivating their stupid anti theft ****. When you get to leave, 2 out of 5 times it sets if off, and then you end up standing there for 20 minutes while the moron goes to the cashier and then to management making sure you didn't steal it even though it is clearly marked on the receipt. I dont have a problem with Sam's or Costco or whathaveyou nearly as much as the wal mart stuff. Sam's generally just takes the receipt and DOES check because they dont have the door beepy thing here, and marks it and wishes you to have a good day while making you feel welcome. Wal-Mart people generally act like you have committed a heinous crime or something. And yes I know they're run by the same company, but the Sam's people are generally more friendly. __________________ Quote:

I pretty much do what the author dose, just keep on walking. I’m at Sam’s Club three to four times a week and have no problems at all. It really annoys me to have to dig my receipt out of my wallet because someone thinks I'm a shoplifter. The guy is being a bit of a jerk about it, but I won't argue with him. |

Registered User Join Date: Aug 2006 Location: Dacula/Marietta, Georgia Posts: 986 | i didnt finish the article, but, i usualy do not stop for those things either. even after working as a customer harraser at best buy for a while, i have even less of a reason to stop. if i didnt steal anything im not likley to stop because there is no reason, if i did steal something there would be no way i would stop. that would just be stupid. as far as a citizens arrest to detain somebody for a reasonable amount of time, that sounds a little far fetched. you can only "detain" somebody that is stupid enough to agree to it. if you harrass them you will be sued. what do yall think about the time you stop at wall mart for a frozen pizza and the customer harrasser decides to choose you (the only person in the store who looks half decently dressed and is obviously able to afford the frozen pizza)? times like these i just keep walking for sure __________________ stuff |

Registered User | I think the author is right for doing so, we as customers should not accpet this. He paid for it and now owns the merchandise and the bag, the "greeter" is now looking through your PERSONAL property, you wouldn't let them look through your coat pockets or purse to make sure. these theft preventention measures don't work anyway, criminals know how to line a bag or purse so sensors don't work, or just remove the item from a sensor. employees know they can't search it, I worked in retail for a bit and the most we could do was ask that they return to the checkout, if they didn't want to then they didn't have to.
