To anwser your question....you are right that your hourly server minimum wage + average tips per hour over a period of time MUST be equal or greater than your states standard minimum hourly wage.
Employers will try and screw you on this, please do not let them, while everyone is going to blame Obama for **** like this, it has more to do with shady companies taking advantage of employees. If it continues call a lawyer.
