Okay, now this is getting out of hand. Sorry to say, 88, but you are SOL. According to the For Sale thread, your contract has been satisfied. Daniel offered for sale one Flowmaster 40 muffler for $65. You accepted his offer and sent the money. He sent you a Flowmaster 40 muffler. The contract is settled. There were no stipulations in the contract as to how soon it would arrive, or how it was to be delivered. You did not request pictures of said muffler so you accepted it AS-IS. What makes you think you can just get your money back and keep the muffler? Your request wouldn't stand up in court, so just drop it. You learned a hard lesson, and so did Daniel. Now you are acting like some righteous idiot and demanding the world. Had you taken the effort to determine exactly what you were buying, you would have seen the rust, etc. Many on here have shown pictures of Flowmasters in worse shape that are approximately the same age. For you to still insist that it is a junkyard muffler is preposterous.

At first I was rooting for you and your cause. Now I see you for the moron you are. No one in their right mind buys something off the internet sight unseen and expects good results. Next time make sure of what you are getting before you accept a contract.


PS- I am not simply spouting my own legal opinions. I spoke with my sister (a paralegal) and her boss (an attorney that deals with property transactions). Both of them said the same thing. It may hurt, but its over.

^ sounds about right, except the moron part. I've bought many things online, much of it used, and I have almost always had very good results. Maybe I've been lucky, but for every scammer trying to pull some scheme, there are five relatively honest people looking to conduct straight business via the internet. I've been one of them.

FWIW, though, it was bad business on Danial's part to sell that chunk of rust without ever specifically mentioning that it's in rough shape. Even worse was his lying and procrastinating.

88, I know what you're going through. I bought an item off ebay a few years back, and when it arrived I found it was broken (not by shipping) to the point of it being essentially destroyed and a danger to use. The pic was taken at an angle so I could not possibly see the damage, but it was obvious when looking at the item in hand. The appropriate feedback was left. Thats all I could really do about it. You don't have a rating system to show your dissatisfaction, so I would do as others have recommended and clean/chop the thing up and sell it for what you can get.


That's probably as close to "fair" as you're gonna get at this point. Good luck to you.

P.S. Personally I think you're well within your rights to ask for a full refund due to the hassle, but that would require your seller to be upright, honest, and above all, a good businessman.

I agree with you, though, the right thing to do on danny's part would be to buy the muffler back from 88. The muffler was not as advertised. From what I've heard, the muffler itself was cut with a torch while it was removed. Damage done to the muffler was denied by Daniel previous to the muffler being sold - Item misrepresentation. 88 has asked for a refund due to these reasons, and has offered to send the muffler back. If Daniel is not willing to do this, he doesn't have to. But clearly it would be the "right" thing to do.

First off NEVER buy any exhaust parts online unless new otherwise............


A muffler generating 50 pages of comments??????and also calls to the police???????


I did read every page and at first was with the buyer but after page 10 I'm like "It's not worth it!" but unfortunatly I only discovered this thread tonight.

My opinion:seller took too long and knew he was screwing the buyer and buyer made the mistake of buying used exhaust parts online.



If I came across too harsh, I apologize cause I've just got halvway through my case of beer I bought at noon.

Hey, I realize I was probably coming across as a ****** bag, but that was mostly for daniel's benefit. I was trying to prod him into doing the right thing, but (to address the comments of many of you), I gave up any actual expectations of that actually happening a while back. It really is the final proof that the kid is a scammer that he won't do the right thing and refund me to ship it back. Even if he'd counter offered to send me back the $65 and ask me to pay return shipping, I'd probably have done it. I wouldn't have been thrilled to take the loss, but at least the scammer wouldn't get to keep the money.

If at literally any step of the way daniel had been willing to do the right thing, this thread never would have been started or turned into what it has. I agree it's about time for this thread to die out.

I've already chalked this one up to a learning experience. While in probably 95% of situations this would have gone just fine, my lack of attention to detail and not insisting on pictures screwed me on this one. The muffler is absolutely for sale, also. Fraser1986brown offered a lifetime JF membership in exchange for it, which I will gladly take if he was serious, otherwise it'll go in the hands of anyone else who wants it. I'll go ahead and start accepting offers via PM's, however I will wait to hear back from Fraser1986brown before closing a deal with anyone else. It would be pretty cool if someone got it and made some sort of "Daniel Hays Edition" label, or if someone else is up to the task of cutting it up and selling the pieces, I'd rather just be rid of the thing.

And once again I thank the members of JF for all of their support and help with this whole thing. If I meet any of you in person, the first round is on me

Myself and a friend of mine skimmed through this thread this morning. We never laughed so hard in our lives. $65 lousy bucks and you guys almost formed a posse to lynch the guy. I'm sure I'll get flamed for this, but really, you should look back and realize just how stupid this whole thing is. Sure, the guy was wrong, but really, UTUBE, Google earth, calling the cops?

88, I think you have done yourself more harm obsessing over this than $65 bucks is worth to anyone. You're also lucky the guy didn't sue you for some of the stuff that was posted here.

Why don't you guys take on DIRECTV for raising the price of the NFL ticket, at least that would be productive.

p.s. I just love Jeeps, and joined here to share information about maintaining and driving my Jeep. I've never been part of a "flamewar". So I'm gonna leave this thread alone. I just had to say something, you guys need a voice of reason.
