That way I don't have to lose money to his lies and attempts to scam, and he can minimize his loss by getting the muffler back to resell. Or, as I mentioned before, if he indeed got this from a junkyard (which by the way, the cuts ARE quite rusty and do NOT look fresh), then he probably doesn't want it back, he can send me the $65 to cover my cost, and he still has a real FM super 40 to sell.
He might have one to sell then, but I highly doubt anyone will buy it from him...

Perhaps not.... but then again, whose fault is that?

So, here's what I gather from this disaster of a thread:

1) Don't buy anything without seeing a picture first

2) Always use a method of payment that gives you some recourse

3) Keep records

4) don't be a scamming piece of ****, cause that sucks.

5) the mob will never be satisfied, Dan Hays could send 88 $200 bucks and a picture of himself with a super 40 up his *** and plenty of JFers will still be calling for his head.

6) don't be a scamming piece of ****

7) Once outside authorities are involved...CLOSE THE THREAD!

8) don't buy anything without seeing a picture first

If something is the fault of two people, then they fairly share the responsibility. If it were my mistake, and I bought a C/C instead of a C/O, then that is no fault of the seller, and entirely my own. In that situation, I'd attempt to resell it and take as little of a loss as possible, or I'd ask for a refund of the purchase price without shipping, and I'd pay return shipping back. Entirely my fault, I bear the financial responsibility. However, this situation is a 17 year old who thought he could get away with taking my money to pay a ticket, and never bother shipping me the muffler. When I finally tracked him down, over a month after sending payment, he told me that it had been shipped out more than three weeks prior. Then he said that the post office delivered it to the wrong address. Then he said that he forgot to stamp it and it never left his post office. Then he just started hanging up on me every time I called him. Then I had to call the police and file a complaint for mail fraud to finally get him to ship me a muffler that he had not accurately represented. Between the month of silence, then the lies, the scamming, and the misrepresentation of the product, I think it's pretty reasonable to call it the seller's responsibility to cover shipping in both directions.

i have read every single post in this thread. i have been on your side since day one. you don't have proof it was not the muffler he was selling because he never sent you any pics nor did you ask for them. that is my point. to continue to demand more out of a 17 year old lying punk kid is just unrealistic.

These rules should be automatically posted as the first post in every for sale item.

And a good picture at that.. not one of those "sorry, my camera sucks.. boo hoo" or one of the "if you enhance the image by x5000 you can see that the muffler is rusted to ****!"

I say close the thread for the victims benefit, if any authoritative bodies are referring to it, and the thread gets out of hand, it can have negative results for the victim.

Well, I just wanted you guys to know that not everyone out there is a ****head. I bought a ring & pinion set from fullcircle4x4 off eBay and they accidentally sent me the wrong set. I let them know and they offered to take this set back, then either refund my money or next day me the right set. Real stand up outfit. Not all places are *******s.

Unfortunately, I have to take a lot of responsibility for being in this predicament, as I didn't take as much care as I should have, as I can't locate my records of what address I sent it to. I screwed myself over by being careless and assuming that I could automatically trust someone simply because they are a JF member. Lesson learned the hard way
this was your original post that started it all. it could have ended with you never receiving anything and nobody ever tracking daniel down.

as it stands, you have a muffler and offers from other people that would buy it. a lot of us have had some entertainment and even offered to send you some money (myself included). treat the super 40 like the berlin wall. take the sawzall to it and cut it up into 13 pieces and sell them for $5. anyone who buys one you can write their name on it with the same white stick that it says flowmaster. then take a pic and post the pic. forum members can use it as an avatar and forever be part of history (or until their year membership runs out).

i'll be the first to send you $5 and then i'll upgrade to a membership so i could use it as my avatar.

Might be a few weeks, I leave for work about 500 miles from home and no internet in a day or two, plus getting the heep fixed after I destroyed it wheeling.
