Guns

I'm watching a show called Street Patrol(rip off of Cops) on Reality TV.

They just arrested a hispanic guy for concealed weapon, discharging a weapon in the city, and possession of a deadly weapon.

Scene: gangsters pull up to join the "party" at this hispanic man's home. hispanic man informs the gangsters this isn't a party, just his personal friends/family drinking and having a good time. gangster pees on a man. hispanic man and friends tell gangsters that's not cool because Ladies are present and tells them to leave. they hear gangsters leaving saying "get our guns". hispanic man(whom owns the home) goes into house and get his personal gun that he bought to protect his children, wife, and home. home owner fires in the air to scare them off AFTER gangters unload 4 or 5 rounds into the area. Cops pull up, the home owner is COMPLETELY cooperates with the police. He puts up his hands, says he has a gun in his waist band, lays down on the ground, gets cuffed, i mean does everything to a T.

Now. Granted. home owner was stupid for shooting in the air, no one knows who or where the bullet would hit. also the home owner could have had pending warrants, failure to appears, probation, gang member himself, etc etc(although none was mentioned).

HOWEVER. why would the cops arrest the home owner?

I feel like the home owner was within his rights even though he did make a stupid mistake by firing into the air.

Discuss.

Where was it? I know in my neck of the woods, dosn't matter if the guy killed your family, did dirty things to your dog, and then proceeded to run towards you in a rambo pose shooting an ak from the hip.... your not supposed to defend yourself, your supposed to call 911.

reckless use of a firearm?? I dont know if that's a charge, but it sounds like he was being a *******...firing into the air

He discharged his firearm in a residential area. I don't know about y'all, but that will get you jail time where i live.

And whether he intended it to or not, his bullet could have killed someone.

its completely different here in florida. Florida law states:
"Under Florida law, there is no "duty to retreat" if you are attacked in any place you have a lawful right to be. Instead, you may stand your ground and meet force with force, including deadly force, if you reasonably believe it is necessary to prevent death or great bodily harm to yourself or others."

So if you start pointing a gun at me I have the right to shoot you if I feel that my life is in danger.

Yea, so i've been told...

I have my 590 set up with rubber shot, i figure legally its the best choice. I had to convince myself it was worthwhile so i shot some milk jugs, im pretty impressed.

Warning shots are B.S. If you're gonna use your firearm, use it.

This man has it right. If the guy saw the Gang members had guns then he should of shot them, because he he feared for his familys and his lives.

I don't know where it was at, I didn't catch that.

So basically what I'm getting here, it depends state by state? possibly city by city?

haha its the dead opposite here

people have shot unarmed trespassors on thier farms who were not posing a threat just trespassing (riding 4wheelers specifically in the situation im thinking of)

and the guy who did it didnt get a charge or have to go to court or anything


im so glad i live in KY and not California, land of fruits and nuts

HE was arrested because he was not defending himself or someone else. A "warning shot" is not a defense shot. According to the law, it is a discharge of a weapon inside the city limits. I'm not sure what city he is in, but in the majority of the south, the concealed weapon and possession of a deadly weapon charges would not stand in court so long as he was on his own property. The possession charge would apply, though, if he was a convicted felon, even if he was on his own property.

This is why I have stated, time and again, that if you conceal carry and use your weapon in defense of yourself or others, you ARE going to be charged for something and spend at least a night in jail. Get to know a lawyer and have his number on speed dial in your cell phone.
