Got a ticket by the CHP for "riding dirty".

By "riding dirty" I mean getting caught with 5% tinted windows. I have a black 2006 Toyota Prius with limo tint windows all around.

I was pulled over about 4 blocks from my house (a residential neighborhood mind you) by a CHP motor cop.

I just had a couple questions out there for the "know it alls" or the "been there done that's".

Can a CHP officer issue a infraction on a city street? I should mention this street he got me on is roughly 1 1/2 miles from a highway, and the road he was on when he saw me, was in no way one that intersects or leads to a highway. He was actually sitting on the corner using his radar.

I anticipate not being able to get out of this, so I figured I would just get some stock windows from a wrecked prius and swap them out for a while then put the others back in. I have had fix-it tickets before, and I know there is a small fee behind it. What happens if I get a second similar citation?

Do you have proof? Does it state it somewhere in the California Traffic Code or Streets and Highway code? I would just like to see it in writing somewhere.

LE in the state of California is LE throughout all of California (according to 1 I used to work with)

In other states jurisdiction is different. It goes city/county/state. City cops have jurisdiction to the city limits and no further unless they have a legal agreement with the county. I worked city, but was also deputized so I had legal jurisdiction outside city limits. County has jurisdiction througout the entire county. State has jurisdiction throughout the entire state. Since this is California Highway patrol I would assume the same. It's not California between the streets of 180'th and 220'th Highway Patrol.

Just because it's HP doesn't mean they are limited strictly to highways.

This is what he snagged me on.

I do live in Napa, which does have a significantly large Police force. I guess it is up to their discretion on if they want to patrol the highway, or sit at the corner of a residential neighborhood?

For some reason I was always under this assumption. In Napa, the police all stay in town, the sherrifs take all the back roads, and the CHP have always stayed on the highways.

A couple years ago our paper published a story on how understaffed they were in the surrounding CHP stations and area's.

So the next question is what happens if I get a second, third, etc. citation. I do not plan on keeping my tint off for very long after it is written off.

Now now people, the guy has a problem. No reason to bash. I would say fix your tint as soon as possible. If you get pulled over, show the ticket you have, and tell the officer/deputy that you are saving up/set a date for the fix. Cops aren't always evil, I would surmise that you will get off....



But just definitely fix it.

Register your vehicle to another state. I live in Minnesota with a vehicle registered in Alaska with Alaska plates. I honestly think I don't get pulled over for WAY too loud exhaust, tires sticking out too far, etc etc, just because they see my plate. It's really nice!

I just don't drive like a fool. Yeah, I get pulled over, but the uniform + lifted jeep usually makes the cop talk to me for a minute and realize that I'm not a stupid kid who likes to speed.



Edit: Not saying the OP is any of that, just making a statement.
