Failed inspection for too much play in front spindle

Is it normal when you pull out on the front wheel that it moves out about 1mm? The inspector said the spindle nut was loose on both front wheels. I tried tightening it but it wouldn't budge. I replaced the CV boots a few years ago so maybe I didn't do something right. It seems to have been driving fine though. I could take it somewhere else where it passed inspection before, but now I'm worried something might be wrong in there.

I think the inspector is full of it.
Sounds like he was trying to "find something" to fix.

I had it inspected at the dealer and it passed so I guess it should be ok to drive.
