wj damaged from neighbors shingles, what to do
ok so its nothing major, its more you can see it and looks odd. since i try to keep my WJ as cleans and ding free from the city parking crap that goes on since its always on the street. but this time i know what caused the damaged to my wj.
we had a bad rain storm Saturday night in NYC and NJ i believe with strong winds that knocked over allot of trees but no was hurts as well as i now which is good. but one of my neighbors shingles were getting ripped off his roof and throw around, most are gone form his roof and all over the streets but i believe one or two hit my jeeps. I left early this morning for a trip so did not look at my jeep and did not get back till late tonight but my father said he noted something so i looked at it as bests i could with a flash light when i got back. going to check it better in the morning and put photos up. the jeep has been parked their since Friday afternoon so no one moved it. my rear glass hatch has a scratch marks about 1ft by 1ft on it that you can see and fell when you move your fingers across but not when you siting the drivers seat. and there are 2 3inch black lines from the tar paper. i believe i can get the tar marks off and i believe the glass can be repaired with a bit of sanding and polishing instead of replacing the entire hatch glass, i have seen kits. anyone have any info on either things? something like http://www.gtglass.com/site/index.html or http://www.janvil.com/ might talk to a few shops and see what happens now my problem is should i try taking to the owner (which i never do) to pay for it and should i contact the cops to get a report done? if i report it with the cops might show up as an accident when a report is run, cause insurance to go up, and proving the shingles caused the damaged might be hard. the cops can say sorry we cant blame him since no hard proof. the guy who owns the house is a old doctor i believe, but allot of family lived in that house and the adjacent house (bought it and ripped out the fence between the two). their odd charters and i think my jeep might "disappear" if i say something. its on the street so cant watch it 24/7. any advice on what i should do repair wise and with the neighbor

I would just repair the damages like you stated and maybe in passing bring it up to your neighbor about the shingles. Unless the damage is more extensive than I am picturing, then you could just try talking to your neighbor politely and see how he reacts.

Don't remove the tar, take pictures of everything.
Go talk to your neighbor calm and explain what you believe happened and why. Most people are understanding and should try to help figure out what to do. I also think since it was caused by something coming off the home, it will be covered by home owner insurance and it isn't really his fault. I could see the home owners insurance covering it along with his roof. Just talk to him and be calm. |

Since the shingles were blown off your neighbor's house in a major storm, I suspect that the resulting damage would be declared an "Act of God".... in other words, there was nothing your neighbor could do to prevent his shingles from being blown off during a major wind storm. This would leave you to repair the damage to your vehicle, or to turn it into your insurance company. Turning it into your insurance company probably isn't an option as you probably have a deductible to deal with.

Something similar happened here when a tree branch fell on a neighbor's car. The insurance wouldn't pay for it because it was an "act of God". The only reason would be if the homeowner were negligent & knowingly left a dead branch up.
I'd guess it might work the same way w/ shingles in a storm. It will be up to your own insurance. Good luck, I'd still try talking to the neighbor & filing a claim. Who knows ? |

You can't prove it in a court of law so forget about it. An act of God as been said here.

thanks for the response guys.
i really think its going to fall into "act of god" and cant prove it. but going to try and talk to him if he will talk to me. just don't like the idea of having to spend $50- $200 to fix the glass. i think i might be able to prove his shingles were loss and some missing from Google earth since their were spots mission for some time on his roof. going to take all the photos tomorrow and then talk to him and came across this Car Insurance Comparision in Black and White - Cleverzebra.co.uk |

I'm an insurance agent and it just depends on each state. If it were in Utah, it would be covered by that persons homeowners insurance. Wind is the cause and that is something that's covered here in Utah. But like I said, each state is different.
Also check with your insurance company about what type of glass coverage they have on your policy.

Don't waste you time talking to you neighbor. His insurance isn't going to cover it. If his tree fell and totalled your car in NY, it would be your insurance claim, not his. Consider yourself lucky that's all the damage you had. It was a sick storm.
Just polish out the glass with polishing compound and you probably wont even notice it anymore.

My neighbor's shingles damaged the paint on my TJ when I lived in WA. As stated before his insurance was not liable as an "act of natur" blew the shingles off. If I wanted to claim it on my comp coverage I could.

depends a lot upon the state but usually an act of god doesn't mean no liability when insurance comes into play. it came from his property so it's his insurance if your state allows for it.

Like mentioned above, your comprehensive will cover it. I shouldn't count as a bad thing against you, since you didn't have anything to do with it. I'm sure it depends on your state. But as mentioned, take pics, call your agent and see what they say.
